Approving a declaration of right-of-way easement on City property for the Eastbound Kellogg RiverCentre Bridge Project.
Body
WHEREAS, the City of Saint Paul ("City") is commencing a project managed by the department of Public Works ("Public Works") for the removal and reconstruction of the Eastbound Kellogg RiverCentre Bridge and road approaches between West 7th Street and Market Street in Downtown Saint Paul, as well as the reconstruction of infrastructure beneath the bridge, including Exchange Street viaduct from Eagle Street to Washington Street and the loading dock exit road; and
WHEREAS, in order to construct the street and bridge improvements as planned, Public Works requires the addition of two small segments of right-of-way ("Easement Areas") along Exchange Street immediately below Kellogg Boulevard; and
WHEREAS, the City possesses underlying fee title ownership of the land required for the additional right-of-way, as evidenced in Certificate of Title Number 624260; and
WHEREAS, the City, upon review and recommendation by Public Works and the Office of Financial Services Real Estate Section, desires to designate and declare the Easement Areas as perpetual right-of-way, as provided for in the Declaration of Right-of-Way Easement attached hereto as Exhibit A; now, therefore, be it
RESOLVED, that the City Council hereby approves said Declaration of Right-of-way Easement and authorizes the proper city officials to record same with Ramsey County Recorder's Office and/or Registrar of Titles.
