Directing the Department of Safety and Inspections to proceed with the 10-day license suspension adverse action against DDDSALYA LLC d/b/a East Market Grocery & Tobacco, (License ID # 20220001990) for the premises located at 913 Payne Avenue.

Body

WHEREAS, the Tobacco Shop license (License ID # 20220001990) (“License”) is held by DDDSALYA LLC d/b/a East Market Grocery & Tobacco, owned by Dhurgham Al Hasimi (“Licensee”), for the premises located at 913 Payne Avenue in Saint Paul (“Licensed Premises”); and

WHEREAS, the Licensee was notified in a letter from the City Attorney’s Office dated December 9, 2025, and titled Notice of Violation and Request for Imposition of 10-Day License Suspension (“Notice”) (Exhibit 1), that the Department of Safety and Inspections (“Department”) recommended a 10-day license suspension for the sale of flavored tobacco products; and 

WHEREAS, the Notice explained that on July 30, 2025, after receiving a complaint, the Department sent inspectors to the Licensed Premises to conduct an inspection, during which the inspectors observed flavored tobacco products behind the counter, which is a violation of Saint Paul Legislative Code § 324.07(j). The inspectors removed the flavored tobacco products from behind the counter and directed that they be taken from the Licensed Premises; and

WHEREAS, the City Council has authority to take adverse action against a Licensee under Saint Paul Legislative Code § 310.03, and that adverse action includes the suspension of a license, Saint Paul Legislative Code § 310.01; and

WHEREAS, Saint Paul Legislative Code § 310.03(m)(3)(2) identifies the presumptive penalty for this violation as a 10-day license suspension; and

WHEREAS, the Department recommends the imposition of the presumptive 10-day license suspension; and

WHEREAS, on December 18, 2025, the Licensee contacted the Department to admit to the violation, accept the penalty, and waive their right to a hearing; and
