Approving the application with conditions, per the Deputy Legislative Hearing Officer, for Gas Station, Cigarette/Tobacco, Restaurant (1) - No Seats, and Retail Food (C) - Grocery 1001-3000 sq. ft., for Northern Tier Retail LLC, d/b/a Superamerica #4151 (ID #20100004247) at 1580 Ford Parkway.

WHEREAS, the Deputy Legislative Hearing Officer recommends that the application for Superamerica #4151 for Gas Station, Cigarette/Tobacco, Restaurant (1) - No Seats, and Retail Food (C) - Grocery 1001-3000 sq. ft., be approved with the following condition:
1. Zoning File 96-080 Special Condition Use Permit to allow redevelopment of an existing auto convenience market is approved with the condition that an eight (8) foot high wood privacy fence shall be installed from the southeastern corner of the building to a point 10 feet west of the sidewalk at Snelling Avenue. The fence shall be maintained and in good repair. All repairs to the fence will be made by June 1, 2011.
2. The licensee shall make sure that all refuse and/or trash will be picked up three (3) times daily on the premises and/or surrounding sidewalks.
THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with the aforementioned agreed-upon conditions.
The modified Conditions Affidavit was signed on April 14, 2011.
