Approving adverse action against the Tobacco Shop License held by DG Retail LLC d/b/a Dollar General Store #19172 (“Licensee”) (License ID# 20170002904) for the premises located at 1055 Payne Avenue.

WHEREAS, the Tobacco Shop license held by DG Retail LLC d/b/a Dollar General Store #19172 (“Licensee”) (License ID# 20170002904) for the premises located at 1055 Payne Avenue was the subject of a Notice of Violation dated December 1, 2022, stating that an Store clerk sold tobacco to an underage person on November 8, 2022, in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 324.07 (i) and
WHEREAS, per Minn. Stat. § 324.10 (b)(1), the licensing office recommended a $500.00 fine; and
WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $500.00 fine or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 fine or request a public or administrative hearing by December 15, 2022, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, DG Retail LLC d/b/a Dollar General Store #19172 (“Licensee”) (License ID# 20170002904) are hereby ordered to pay a $500.00 fine for the sale of tobacco to an underage person on November 8, 2022.
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
