Title

Authorizing the granting of a license and parkland diversion to the petitioner at 359 Winslow Avenue within the Prospect Boulevard.

Body

WHEREAS, the City of Saint Paul (“City”) is owner of parkway property in Saint Paul identified as Prospect Boulevard; and

 

WHEREAS, the owner of 359 Winslow Avenue (“Petitioner”) is requesting that the City grant a permanent license, a copy of which is on file in the Office of Financial Services, Real Estate Section, to construct a driveway over a portion of Prospect Boulevard for access to a new garage at Petitioner’s property, as outlined in the attached Exhibit A; and

 

WHEREAS, the grant of license constitutes a diversion of parkland in accordance with Section 13.01.1 of the City Charter; and

 

WHEREAS, Petitioner has agreed to pay just compensation as determined by an independent appraisal pursuant to Section 13.01.1 of the Saint Paul City Charter; and

     

WHEREAS, the Saint Paul Parks and Recreation Commission recommends diversion of the parkland, as stated in its Resolution #23-04 adopted September 14, 2023 and as shown in Exhibit B; and

 

WHEREAS, the City of Saint Paul Department of Parks and Recreation approves of the petition for parkland diversion; now, therefore be it

 

RESOLVED, that the proper city officials are hereby authorized and directed to grant to Petitioner a permanent license, in a form and content substantially as set forth herein, for the use of a portion of Prospect Boulevard adjacent to 359 Winslow Avenue; to accept just compensation from Petitioner to be deposited into the Parkland Replacement Fund, which is to be held in reserve for future purchase of park property as required in Chapter 13.01.1 of the City Charter; and to be fully compensated by Petitioner for all fees required by the City to comply with its parkland diversion guidelines
