Approving adverse action against the Taxicab Driver license held by Jason L. Schlais.

WHEREAS, the Taxicab Driver license held by Jason L. Schlais (License ID #20130001172) for the City of Saint Paul was the subject of a Notice of Intent to Revoke License dated March 26, 2015, stating the licensee had his Minnesota Driver's License suspended twice within the past eight (8) months and failed to notify the Department of Safety and Inspections in violation of Saint Paul Legislative Code § 376.16 (k) (1); and
WHEREAS, in addition, the licensee was cited for five (5) moving violations within the last twenty-four (24) months in violation of Saint Paul Legislative Code § 376.16 (e) (5) (c); and
WHEREAS, based on this information, the licensing office recommended revocation per Saint Paul Legislative Code § 376.16 (k) (5) and;
WHEREAS, On March 30, 2015, the licensee responded to the Notice of Intent to Revoke License to state he disputed the facts and was instructed to submit a written request for an administrative hearing by the April 6, 2015 deadline; and
WHEREAS, the Notice of Intent to Revoke License stated that if the licensee failed to request a public or administrative hearing April 6, 2015, that the matter would be placed on the consent agenda to impose the recommended penalty; and
WHEREAS, on April 7, 2015, the City Attorney's Office called and left a message with the licensee to inquire as to the status of his request for an administrative hearing and was given until April 10, 2015 before the Department of Safety and Inspections would move forward with the adverse action and submit a resolution to City Council; and
WHEREAS, the licensee failed to respond to the telephone message to submit a written request for an administrative hearing by the April 10, 2015 deadline; now, therefore, be it
RESOLVED, that the Taxicab Driver license held by Jason L. Schlais is hereby revoked.
