Title

Approving an Omnibus Agreement between the City of Mendota Heights and the Board of Water Commissioners.

 

Body

WHEREAS, the Board of Water Commissioners of the City of Saint Paul (the “Board”) and the City of Mendota Heights (“Mendota Heights”) did enter into an agreement on December 27, 1995 (the “1995 Agreement”) which continued retail water service to the residents of Mendota Heights; and

 

WHEREAS, the 1995 Agreement is due to expire on December 26, 2015; and

 

WHEREAS, staff of the parties have negotiated an agreement that provides for the transfer of ownership of Mendota Heights’ water system to the Board and phases in a reduction of water rates to eventually equal those charged to City of Saint Paul properties (“Omnibus Agreement”), which is similar to agreements the Board has with the cities of West St. Paul, Falcon Heights, Lauderdale, and Maplewood; and

 

WHEREAS, Mendota Heights City Council has approved the Omnibus Agreement; and

 

WHEREAS, Saint Paul Legislative Code Section 85.04 requires the adoption of a resolution by the Council of the City of Saint Paul authorizing such agreements; and

 

WHEREAS, the Board did adopt Resolution No. 15-2140, which approved the Omnibus Agreement and which requested that the Honorable Council of the City of Saint Paul authorize said Omnibus Agreement; now, therefore, be it

 

RESOLVED, that the Omnibus Agreement between the City of Mendota Heights and the Board of Water Commissioners of the City of Saint Paul providing for the transfer of ownership and operation of Mendota Heights’ water system to the Board is hereby authorized, and that the proper officers are hereby directed to execute said Omnibus Agreement on behalf of the City of Saint Paul.
