Approving adverse action against all licenses held by Dethvongxay Sonvanaphong, d/b/a Thai Ginger Deli, 1001 Johnson Parkway, Unit #7.
Body
WHEREAS, adverse action was taken against all licenses held by Dethvongxay Sonvanaphong d/b/a Thai Ginger Deli (License ID #20100003775) for the premises located at 1001 Johnson Parkway, Unit #7 in Saint Paul by Notice of Violation dated September 30, 2011, alleging the licensee was cited for two (2) Critical-Major Environmental Health Code violations during a re-inspection of the licensed premises on August 22, 2011; and   
 
WHEREAS, pursuant to Saint Paul Legislative Code ยง 310.05 (m) (9), the licensing office recommended a $400.00 matrix penalty for the two (2) violations and suspension of all licenses until the licensee corrected the violations; and  
 
WHEREAS, the licensee did respond to the Notice of Violation on October 10, 2011 to pay the $400.00 matrix penalty and indicated that he would contact the inspector to schedule a re-inspection; and
 
WHEREAS, on October 28, 2011, the DSI Inspector contacted the City Attorneys Office to update them indicating the licensee still had not contacted him to schedule a re-inspection; and
WHEREAS, the Notice of Violation stated that if the licensee failed to schedule a re-inspection or request a hearing by October 10, 2011, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
 
RESOLVED, that all licenses held by Dethvongxay Sonvanaphong d/b/a Thai Ginger Deli are hereby immediately suspended until the two (2) Critical-Major Environmental Health violations are corrected and approved by the DSI Environmental Health Specialist.
