WHEREAS, adverse action was taken against the Restaurant (1) - No Seats license held by Lucky Pizzas & Pastas, LLC d/b/a Luckys Pizzas & Pastas (License ID #20080003151) for the premises located at 1215 Randolph Avenue in Saint Paul by Notice of Violation and Notice of Intent to Suspend License dated February 10, 2011, alleging that during an Environmental Health inspection on January 12, 2011, the inspector found cigarette butts and ashes in the food prep sink and an ashtray full of cigarette butts in the employee area of the basement in violation of Saint Paul Legislative Code § 238.04 (1) and (2); and

WHEREAS, per Saint Paul Legislative Code §310.05 (m) (2), the licensing office recommended a $500.00 matrix penalty; and

WHEREAS, licensee also failed to pay delinquent license and late fees of $652.00; and

WHEREAS, on February 14, 2011, the Department of Safety and Inspections received payment of $652.00 in delinquent license and late fees but did not receive the $500.00 matrix penalty for the smoking violation; and

WHEREAS, on March 2, 2011, a Notice of Intent to Suspend License was sent to the licensee stating that the $500.00 matrix penalty was still due for the smoking violation and the licensee also needed to submit a completed Certificate of Compliance Minnesota Workers Compensation Law form; and

WHEREAS, the licensee did not respond to the Notice of Intent to Suspend License to pay the $500.00 matrix penalty and submit the requested information or request a hearing; and

WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the $500.00 matrix penalty and submit the requested information by March 14, 2011, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be ...
