Approving a Declaration between the Metropolitan Council and the City of Saint Paul for the protection, operation, and maintenance of a shared Rainwater Harvesting System constructed within portions of the Light Rail Transit Operations and Maintenance Facility and the Lowertown Regional Ballpark.

WHEREAS, the Metropolitan Council ("Council") is fee owner of real property located at 340 Broadway Street, which is the site of the Council's Light Rail Transit Operations and Maintenance Facility ("OMF"); and
WHEREAS, the City of Saint Paul ("City") is fee owner of real property located at 310 Fifth Street East, which is the site of the new Lowertown Regional Ballpark (the "Ballpark") currently under construction; and
WHEREAS, the Council and City have executed a grant agreement whereby the Council will provide $100,000 to the City to design and construct a Rainwater Harvesting System at the Ballpark to store and re-use rainwater captured from a portion of the roof area of the OMF over the next 50 years; and
WHEREAS, the Council and City desire to declare and jointly establish the responsibilities of each party with regard to protection, operation and maintenance of the shared Rainwater Harvesting System, and have prepared a Declaration of Agreement to memorialize said responsibilities, attached hereto as Exhibit 1; now, therefore be it
RESOLVED, that the Council of the City of Saint Paul hereby approves said Declaration and authorizes and directs the proper city officials to execute and to record same with the Ramsey County Office of the Recorder and/or Registrar of Titles.
