Authorizing lease and parkland diversion for T-Mobile at Edgcumbe Rec Center

Body
WHEREAS, the City of Saint Paul, Department of Parks and Recreation (“Parks & Recreation”), owns park land known as Edgcumbe Recreation Center, located at 320 Griggs Street South (the “Rec Center Property”); and

WHEREAS, T-Mobile Central, LLC (“T-Mobile”) has requested use of portions of the Rec Center Property for the installation and operation of cellular communications equipment, including underground cabling, utility lines, a cell tower, antennas, cabinet and ancillary equipment, as shown on Exhibit A; and

WHEREAS, T-Mobile has been negotiating a 15-year lease with Parks & Recreation for said communications activities, which will provide over $16,000 in annual revenues for Rec Center Property operations and maintenance without disrupting recreational services to the community; and

WHEREAS, the placement of said communications equipment on the Rec Center Property will constitute a diversion of park land in accordance with Section 13.01.1 of the City Charter; and

WHEREAS, T-Mobile has requested the diversion of said Rec Center Property for use by T-Mobile for its proposed communications activities, as depicted on the drawing attached hereto as Exhibit B, a copy of which is on file in the Office of Financial Services, Real Estate Section, file number 06-PKLDVRS-2010; and has agreed to pay just compensation as determined by an independent appraisal pursuant to Section 13.01.1 of the Saint Paul City Charter; and

WHEREAS, Parks & Recreation recommends granting to T-Mobile a 15-year lease for the use of the Rec Center Property for said communications activities; and further recommends approval of the diversion of the Rec Center Property; and

WHEREAS, the Saint Paul Parks & Recreation Commission recommends diversion of the the Rec Center Property, as stated in its resolution adopted October 13, 2010, and shown on Exhibit C; now, therefore be it
