Approving the Legislative Hearing Officer's recommendation, with conditions, for the application submitted by Aubergine Hospitality LLC (License ID#DSIBLLIQ-000182-2025), d/b/a Restaurant Aubergine, for Liquor On Sale - 100 seats or less, Liquor On Sale - Sunday, and Liquor Outdoor Service Area (Patio) licenses, located at 525 Selby Avenue.

WHEREAS, Aubergine Hospitality LLC (License ID#DSIBLLIQ-000182-2025), d/b/a Restaurant Aubergine, located at 525 Selby Avenue, has applied for Liquor On Sale - 100 seats or less, Liquor On Sale - Sunday, and Liquor Outdoor Service Area (Patio) Class N licenses; and
WHEREAS, the applicant notified the Summit-University Planning Council prior to submitting their application; and
WHEREAS, a notification regarding the license application was sent from the Department of Safety and Inspections to the affected neighborhood for the period of September 4, 2025, to September 19, 2025; and
WHEREAS, during the notification period, objections were received which triggered the hearing and a hearing was held on October 20, 2025; and
WHEREAS, the objections were related to noise, hours, late-night maintenance, and after-hours contacts; and
WHEREAS, in response to the concerns raised, the licensee has agreed to work with the city to comply with the necessary requirements to minimize nuisance activities that would disturb the surrounding residential neighborhood, including willingness to share contact information; and
WHEREAS, after conducting the hearing and considering the testimonies and evidence presented, the Legislative Hearing Officer recommends approval of the application submitted by by Aubergine Hospitality LLC (License ID#DSIBLLIQ-000182-2025), d/b/a Restaurant Aubergine, located at 525 Selby Avenue, subject to the following conditions:
1. Licensee agrees to operate the establishment in compliance with Section 409.02 of the City of Saint Paul Legislative Code as a "Restaurant".
