Approving the application of Public Works Bridge Division for a sound level variance in order to perform overnight work for the construction/demolition project of westbound Kellogg Boulevard Bridge 62574 from Wednesday, August 1 through Sunday, September 30, 2018.

Body
WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and

WHEREAS, §293.09 provides for the granting of variances from the sound level limitations contained in §293.07, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on the applicant, other persons or on the community; and

WHEREAS, Public Works, represented by Brent Christensen, Project Engineer, has applied for a variance, at a requested sound level limit of a Max L10 80 dBA at 50 feet from the source, for construction work, including joint replacement and overnight mill and overlay construction work on Westbound Kellogg Blvd Bridge 62574 from the intersection of West 7th Street to Washington Street, and to allow elevated sound levels from 10:00 p.m. until 7:00 a.m. for activities such as use of pneumatic hammers, media blasting, power screed, surface removal, milling and asphalt rollers and paving, bobcat use, back up equipment with beepers, dump trucks, and street sweepers, and hand power tools; and

WHEREAS, in order to meet required repair criteria, strict date, temperature and weather requirements as mandated by the state, project completion and to minimize disruption to traffic on the described project areas, area businesses, the public, adjoining residents and property owners, the applicant is seeking a 10:00 p.m. until 7:00 a.m. overnight variance, to occur in duration of one-two days at a time, with maximum of four to eight days in total, at a sound level limit of a Max L10 80 dBA at 50 feet, during the period of Wednesday, August 1, 2018 until Sunday, September 30, 2018; and
