Approving adverse action against all licenses held by Jerry Castillo d/b/a Amigos Auto Center & Sales located at 1445 Arcade Street in Saint Paul.

WHEREAS, adverse action was taken against all licenses held by Jerry Castillo d/b/a Amigos Auto Center & Sales (License ID #20060003581) for the premises located at 1445 Arcade Street in Saint Paul by Notice of Violation and Notice of Intent to Suspend Licenses dated September 13, 2010, alleging that licensee violated several license conditions which were cited by a DSI inspector during an inspection on August 25, 2010; and
WHEREAS, this was the second instance of license condition violations since February 19, 2010, so the licensing office recommended a $1,000.00 matrix penalty and required that the licensee bring his establishment into compliance with license conditions and storage requirements within thirty (30) days; and
WHEREAS, the licensee did respond to the Notice of Violation on September 27, 2010 to request an extension and to set up a payment plan with DSI to make one $500.00 payment on October 29, 2010 and the second $500.00 payment on November 29, 2010; and
WHEREAS, an inspection was conducted at the licensees establishment on November 19, 2010 and the inspector found the licensee was in compliance with his license conditions; and
WHEREAS, a check of DSI records on December 1, 2010, showed the licensee failed to make either of the $500.00 payments from the agreed upon payment plan due on October 29, 2010 and November 29, 2010; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $1,000.00 matrix penalty, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that all licenses held by Jerry Castillo d/b/a Amigos Auto Center & Sales are immediately suspended for failure to pay the $1,000.00 matrix penalty.
