Repealing special assessment policies in Appendices A-7 and A-8 of the Administrative Code.
Body
WHEREAS, the City’s Administrative Code includes several appendices to memorialize resolutions adopted in the past by former City Councils on a variety of city matters; and
WHEREAS, Chapter A-7. - Policy-Certain Local Improvements, and Chapter A-8. - Special Assessment Policy (the “Appendices”), attached hereto as Exhibit A, were intended to provide guidance for assessing the cost of local improvements such as street reconstruction, lighting, sidewalks, alleys and sewers; and
WHEREAS, said assessment policies, which were established and revised in 1976, 1981 and 1984 by City Council resolutions and included in the Appendices, were never codified by ordinance and also no longer reflect current assessment policy; and
WHEREAS, the Saint Paul Streets Program Policies (“SPS Policies”), attached hereto as Exhibit B, were established by the Mayor’s Administration in February, 2018 and received by the City Council on March 14, 2018 (RES 18-395), said policies providing current guidance for the calculation and implementation of special assessments for street reconstruction projects and other local improvement projects; and
WHEREAS, because most of the assessment policies enumerated in the Appendices do not reflect current policies as provided in the SPS Policies, it is therefore necessary to repeal the Appendices to eliminate any confusion or conflict; and
WHEREAS, in addition to the City's efforts in recent years to establish the SPS Policies governing the assessment of street reconstruction projects, the City has been developing policies for the establishment of fees and collection of assessments for services provided through the Street Maintenance Service Program ("SMSP"); specifically, citywide sweeping and lighting, sealcoating, and mill and overlay services; and
