WHEREAS, the Short-Term Rental (Owner-Occupied) license held by Vlad Messing d/b/a Vlad I Messing (License ID #20210000636) for the premises located at 911 Dayton Avenue in Saint Paul was the subject of a Notice of Intent to Suspend License and Request Imposition of $500 Matrix Penalty (Notice”) dated June 5, 2023; and
WHEREAS, Saint Paul Legislative Code §310.03(m)(1)(2) provides for a presumptive penalty of $500.00 for a first-time violation of a provision of the legislative code related to the licensed activity; and
WHEREAS, Saint Paul Legislative Code §310.03 (m) (8) sets the general penalties for failure to pay license fees. The matrix prescribes a penalty of license suspension for a first-time violation; and
WHEREAS, the Notice stated that on February 17, 2023, the licensee was sent an email from a DSI Inspector stating that his Short-Term Rental (Owner-Occupied) license had expired and was now delinquent; and
WHEREAS, the licensee was instructed to complete and sign the Affidavit of Compliance located on the renewal invoice and return it along with payment of the delinquent license fees; and
WHEREAS, on April 13, 2023, DSI sent a follow-up letter to the licensee requesting payment of the delinquent license fees and submission of a signed Affidavit of Compliance by May 8, 2023; and
WHEREAS, the Notice sent gave the licensee until June 15, 2023, to 1) pay the delinquent license and late fees and submit a signed Affidavit of Compliance; 2) request a hearing before City Council; 3) request an Administrative Hearing or 4) complete and return an attached Request to Cancel License with the City of Saint Paul; and
