Title

Pertaining to an Amendment No. 1 to Agreement with the City of Mendota to change the dates for required payments regarding the installation of a pressure reducing valve.

 

Body

WHEREAS, the Board of Water Commissioners of the City of Saint Paul and the City of Mendota (“Mendota”) entered into an agreement dated May 8, 2018 for the provision of water service by the Board to properties within the City of Mendota (the “Contract”); and

 

WHEREAS, as part of the Contract, the Board and Mendota agreed that a pressure reducing valve is necessary to bring pressures in Mendota’s mains to a range of operating levels acceptable to the Board and that the cost of labor, material, and equipment for this installation is to be shared by Mendota and the Board, with 80% of the actual costs borne by Mendota and 20% of the actual costs borne by the Board; and

 

WHEREAS, payments are to be made to the Board of five (5) equal annual installments with the first annual payment by Mendota to the Board due January 1, 2019; and

 

WHEREAS, installation of said pressure reducing valve has not been completed and total actual costs are unknown at this time; and

 

WHEREAS, the parties desire at this time to amend the Contract to change the due dates for said installment payments by one year; and

 

WHEREAS, staff has prepared and recommends approval of Amendment No. 1 to Agreement which changes the due dates for said payments; now, therefore, be it

 

RESOLVED, that the Board of Water Commissioners of the City of Saint Paul does hereby approve Amendment No. 1 to Contract for Water Service between the Board of Water Commissioners of the City of Saint Paul and the City of Mendota, and that the proper officers are hereby authorized and directed to execute said Amendment No. 1 on behalf of the Board, following approval by the assistant city attorney.
