Second Making finding on the appealed substantial abatement ordered for 401 ROSE AVENUE EAST in Council File RLH RR 24-11.

WHEREAS, the City Council adopted RLH RR 24-11 on March 13, 2024 which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 401 Rose Avenue East; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on September 24, 2024 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated, but will grant an additional 180 days and continue the original $5,000 performance deposit, pending posting of an additional $5,000 and submission of updated work plan and schedule;  and

 

WHEREAS, the above-listed conditions have been met and the Legislative Hearing Officer recommends a 180 days be granted to abate the nuisance condition by way of rehabilitation or razing and removal of the property; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is not abated, but will grant 180 days to complete abatement of the nuisance by way of rehabilitation or razing and removal and continue performance deposit, if conditions met, and refers the matter to Legislative Hearing April 22, 2025 and City Council Public Hearing May 7, 2025.
