Approving a Contingent Purchase Agreement for the City's purchase of land from the Saint Paul Port Authority for the construction of a new Fire Station No. 7.

WHEREAS, the Saint Paul Fire Department (“Fire”) has proposed to replace its antiquated and functionally obsolete Fire Station No. 7 with a new fire station in order to provide improved fire and emergency medical service within its geographic service area (the "Project"); and
WHEREAS, through the City of Saint Paul (“City”) capital budget process, funding has been provided to commence with the Project; and
WHEREAS, an initial step in the process is to secure land for the new building that will accommodate Fire’s space needs and remain centrally located within its service area; and
WHEREAS, the City has identified a 26,000 square foot parcel of vacant land that will meet Fire’s needs, which is owned by the Saint Paul Port Authority (“Port”) and situated at the northwest corner of Ross Avenue and Earl Street, directly across the street from the existing fire station (the “Port Property”); and
WHEREAS, the City and Port have engaged in discussions about the City’s purchase of the Port Property, and have negotiated a purchase price and prepared a Contingent Purchase Agreement, attached hereto as Exhibit A, with terms acceptable to both parties; and
WHEREAS, the City and Port are now prepared to execute said Contingent Purchase Agreement, subject to approval by the City Council and Port Authority Board of Commissioners; now, therefore, be it
RESOLVED, that the Saint Paul City Council hereby approves said Contingent Purchase Agreement and authorizes the proper city officials to execute the same, and any documents necessary to effectuate the sale and purchase of the Port Property.
