Title

Amending Section 409.06(i)(2)(a) of the Saint Paul Legislative Code pertaining to certain location restrictions for off-sale liquor licenses.

Body

WHEREAS, Legislative Code section 409.06(i)(2)(a) prohibits location of an off-sale liquor establishment within a half-mile of the Xcel Energy Center, and

WHEREAS, upon further review, the Council finds that reducing the regulated area from a half-mile to a quarter-mile of the Xcel Energy Center is a less restrictive alternative that protects the health, safety, and welfare of the residents of Saint Paul while balancing area economic interests.

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

SECTION 1

That Section 409.06 (i)(2)(a) of the Saint Paul Legislative Code is hereby amended to read as follows:

a.  Notwithstanding the foregoing, no off-sale liquor establishment, except for off-sale wine only, shall be located within a half-mile quarter-mile radius of the Xcel Energy Center.

SECTION 2

This Ordinance will take effect and be in force thirty (30) days following its passage, approval and publication.
