WHEREAS, the Cigarette/Tobacco license held by Jubilee St Marie’s of St Paul d/b/a Jubilee - St. Marie’s (License ID #0012161) for the premises located at 101 - 5th Street East in Saint Paul, was the subject of a Notice of Violation dated July 19, 2016, stating an employee of the licensee sold tobacco products to an underage person on July 15, 2016 in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 324.07 (c) and (d); and
WHEREAS, this was the second violation within the past twelve (12) months, so per Saint Paul Legislative Code § 324.11(b) (1), the licensing office recommended a $400.00 matrix penalty; and
WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $400.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $400.00 matrix penalty or request a public or administrative hearing by July 29, 2016, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Jubilee St Marie’s of St Paul d/b/a Jubilee - St. Marie’s is hereby ordered to pay a $400.00 matrix penalty for the sale of tobacco products to an underage person on July 15, 2016.
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
