Title

Approving the execution of a perpetual driveway, greenspace and utility easement between the City and the residential property owners at 436 Wheelock Parkway East for their access across a city-owned parcel.

Body

WHEREAS, in 1908 the City of Saint Paul ("City") acquired a parcel of land ("City Parcel") as part of the opening of the Wheelock Parkway right-of-way, as depicted in the Aerial View map attached hereto; and

 

WHEREAS, a small portion of the City Parcel extending westerly of Wheelock Parkway was not needed for right-of-way purposes, and without the City's knowledge was developed as driveway and front yard area for the private residential property at 436 Wheelock Parkway East; and

 

WHEREAS, the property owners of 436 Wheelock Parkway East now wish to secure legal access to their property from Wheelock Parkway, and specifically request a perpetual easement for driveway, greenspace and utility access purposes ("Easement") across the City Parcel; and

 

WHEREAS, the City's Department of Public Works has determined that the City has no use of the City Parcel and supports the conveyance of the Easement to said property owners; now, therefore, be it

 

RESOLVED, that the Mayor and City Council do hereby approve the Easement in a form and content substantially as set forth in Exhibit A attached hereto, and authorize and direct the proper city officials to execute said Easement.
