Approving adverse action against the Restaurant (2) 1-12 Seats license application submitted by Pizza Three LLC, d/b/a Pizza 3, 1556 Selby Avenue.

WHEREAS, adverse action was taken against the Restaurant (2) 1-12 Seats license application submitted by Pizza Three LLC d/b/a Pizza 3 (License ID #20120005369) for the premises located at 1556 Selby Avenue in Saint Paul, by Notice of Intent to Deny License dated March 28, 2013, alleging licensee failed to contact DSI regarding the status of his application; and
WHEREAS, the licensee did respond to the Notice of Intent to Deny License on April 8, 2013 to state he no longer wished to pursue a Restaurant (2) 1-12 Seats license at that location and would send a letter to DSI withdrawing his license and requesting a refund; and
WHEREAS, the licensee failed to follow-up after the telephone conversation to submit the letter to DSI withdrawing his license application and requesting a refund; and
WHEREAS, the Notice of Intent to Deny License stated that if the licensee failed to contact DSI regarding the status of the license application or request a hearing by April 8, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Restaurant (2) 1-12 Seats license application submitted by Pizza Three LLC d/b/a Pizza 3 is hereby denied.
