Authorizing the City to enter into an agreement with the State of Minnesota Department of Transportation for work in the Trunk Highway 35E right of way as part of the City’s University Avenue Project.
Body
WHEREAS, City has a project on University Avenue from Trunk Highway 35E to Lafayette Road; and
WHEREAS, this project includes work upon, along, and adjacent to Trunk Highway 35E, the limits of which are defined in said agreement; and
WHEREAS, the City requests that the State of Minnesota allow construction of improvements within the defined limits and the State of Minnesota is willing to allow said construction; and
WHEREAS, the City’s maintenance responsibilities for these improvements are defined in the agreement; now, therefore, be it
RESOLVED, that the Mayor and the proper City Officials are hereby authorized and directed for and on behalf of the City to enter into MnDOT Agreement No.1061967 with the State of Minnesota, a copy of which is before Council and is made a part hereof; and, be it finally
RESOLVED, that the Mayor and the proper City Officials are authorized to execute the agreement and any amendments to the agreement.
