WHEREAS, in the matter of the Appeal of Laura Goodman, St. Catherine University, to a Re-Inspection Fire Certificate of Occupancy With Deficiencies at 2004 RANDOLPH AVENUE (O'SHAUGHNESSY THEATER), the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant the appeal based on conditions being met by September 1, 2012:
1) smoke detectors will be added in the area where they are holding storage in the tunnel;
2) storage will not expand;
3) pre-planning with the responding fire department will occur routinely and no less than every 2 years;
4) mattresses and couches will be removed or re-located into the adjacent sprinkled area;
5) other storage will be re-arranged to preventpotential fires from aisle jumping;
6) preventative maintenance on the belts, etc.will continue to be co-ordinated in that air-handling area with the safety checks; and
7) exit signage / emergency light packs will be added at both the existing exit sign and at the "ship's ladder" to platform;

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
