Approving adverse action against all licenses held by La Fonda, LLC d/b/a La Fonda Mexican Eats located at 433 Robert Street South in Saint Paul.

WHEREAS, adverse action was taken against all licenses held by La Fonda LLC, d/b/a La Fonda Mexican Eats (License ID #20090002674) for the premises located at 433 Robert Street South in Saint Paul by Notice of Violation dated October 7, 2010, alleging that on September 7, 2010, the licensee submitted a Certificate of Liquor Liability Insurance with a lapse in coverage from September 16, 2009 through August 20, 2010; and
WHEREAS, per Saint Paul Legislative Code ยง 409.26 (b) (12), the licensing office recommended a ten (10) day closure of the establishment for failure to comply with statutory and ordinance requirements for liability insurance; and
WHEREAS, licensee did respond to the Notice of Violation to request a public hearing which was held on November 17, 2010, and now, therefore, be it
RESOLVED, that all licenses held by La Fonda LLC, d/b/a La Fonda Mexican Eats are hereby suspended for ten (10) days. Said suspension will begin at 12:00 a.m. on Wednesday, December 8, 2010, until 12:00 p.m. on Friday, December 17, 2010.
This resolution, and action taken above, is based upon facts contained in the October 7, 2010, Notice of Violation sent to the licensee and the arguments made at the public hearing on November 17, 2010.
