Title

Authorizing the City's execution of a permanent easement agreement with Snelling Properties, LLC for use as a private parking lot.

 

Body

WHEREAS, on January 15, 2020 the City Council adopted RES PH 20-14 to authorize the vacation and disposal of a 2.2-acre portion of city property located at the Public Safety Garage and Fire Training Center site, 1675 Energy Park Drive ("Fire Site"), for redevelopment as a parking lot by Snelling Properties, LLC ("Adjacent Owner"), whose property is located at 1625, 1635 and 1645 Energy Park Drive; and

 

WHEREAS, said resolution authorized the execution of a sale/purchase agreement for the conveyance of the 2.2 acres from the City of Saint Paul ("City") to the Adjacent Owner; and

 

WHEREAS, subsequent to the Council action, the City and Adjacent Owner engaged in further discussions that resulted in a redesign of the parking lot area and a significant reduction in requested land area within the Fire Site, said area being 5,175 square feet along the east line of the Fire Site and abutting the Adjacent Owner's property; and

 

WHEREAS, the City and Adjacent Owner have agreed that the City will convey a permanent easement ("Easement") to construct and maintain parking improvements within the easement area, as documented in the Permanent Easement Agreement attached hereto as Exhibit A, and that the Adjacent Owner will compensate the City for the Easement; now, therefore, be it

 

RESOLVED, that the City Council hereby authorizes and directs the proper City officials to execute the Permanent Easement Agreement in a form and content substantially as set forth in Exhibit A attached hereto, and to accept compensation for the Easement from the Adjacent Owner, to be deposited into the proper city account as determined by the Office of Financial Services.
