Approving the release of fire access easements over the private property located at 1645 Energy Park Drive.

WHEREAS, on November 4, 1972 the City of Saint Paul ("City") was granted a fire access easement, as documented in Ramsey County Records Doc. No. 1844694, (the "1972 Easement") over real property located at 1645 Energy Park Drive, Saint Paul, Parcel ID No. 28-29-23-14-0002 (the "Property"); and
WHEREAS, in 2006 a new fire access easement was granted to provide for the re-routing of the easement area within the Property, as documented in Ramsey County Records Doc. No. 3952785 (the "2006 Easement"); and
WHEREAS, the owner of the Property has requested the City's release of the 1972 Easement and 2006 Easement, and the City has agreed because there is no longer a need for said fire access across the Property; now, therefore be it
RESOLVED, that the City Council hereby approves the release of the 1972 Easement and the 2006 Easement, and authorizes the proper city officials to execute and record a "Termination and Release of Easements" document in the office of the Ramsey County Recorder and/or Registrar of Titles in a form and content substantially as set forth in Exhibit A attached hereto.
