Approving adverse action against the Cigarette/Tobacco license held by Super KM 99 Cents, Inc. d/b/a Dragon Dollar Plus located at 315 University Avenue West, Unit C in Saint Paul.

WHEREAS, the Cigarette/Tobacco license held by Super KM 99 Cents, Inc. d/b/a Dragon Dollar Plus (License ID #20130001045) for the premises located at 315 University Avenue West, Unit C in Saint Paul, was the subject of a Notice of Violation dated June 25, 2015, stating the licensee sold tobacco products to an underage person on June 18, 2015; and
WHEREAS, this was the third violation for the sale of tobacco products to an underage person within the past eighteen (18) months; and
WHEREAS, per Saint Paul Legislative Code §324.11 (b) (1), the licensing office recommended an $800.00 matrix penalty and a seven (7) suspension of her Cigarette/Tobacco license; and
WHEREAS, the licensee did respond to the Notice of Violation to discuss her options, but she failed to follow-up with a request for a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to request a public or administrative hearing by July 6, 2015, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Super KM 99 Cents, Inc. d/b/a Dragon Dollar Plus is hereby ordered to pay an $800.00 matrix penalty for the sale of tobacco products to an underage person on June 18, 2015.
FURTHER RESOLVED, the Cigarette/Tobacco license held by Super KM 99 Cents, Inc. d/b/a Dragon Dollar Plus is hereby suspended for seven (7) days. Said suspension will begin at 12:00 midnight on Wednesday, August 26, 2015 and end at 11:59 p.m. on Tuesday, September 1, 2015.
