Title
Amending Chapters 60,61,68, and 72 of the Legislative Code pertaining to the Mississippi River Corridor Critical Area and the Flood Plain Management Overlay Districts.
Body

WHEREAS, the Saint Paul Zoning Code, found in chapters 60 through 69 of the Saint Paul Legislative Code, is established to:
• implement the policies of the comprehensive plan;
• fix reasonable standards to which buildings, structures and uses shall conform; and
• protect water resources, improve water quality, and promote water conservation; and

WHEREAS, Chapter 72 of the Saint Paul Legislative Code is established to guide floodplain development in order to lessen the adverse effects of floods and to minimize loss of life, threats to health, private and public economic loss caused by flooding, and to comply with the rules and regulations of the National Flood Insurance Program; and

WHEREAS, Section 61.801(a) of the Zoning Code calls for periodic review of said codes to reflect current City policies, to address changes in state laws, and to bring the zoning code up to date; and

WHEREAS, in 1976, the Mississippi River Corridor Critical Area Plan (MRCCA) was designated as a state critical area by Governor Wendel Anderson (Executive Order No. 130) to protect its natural, cultural and scenic resources through coordinated land planning and regulation for the 72-mile stretch of the Mississippi River through the seven-county metropolitan area.; and

WHEREAS, in 2017, new MRCCA rules were adopted by the state, which include specific zoning code provisions, definitions, and regulations that local units of government within the seven-county metropolitan area are required to adopt; and

WHEREAS, in 2019 the DNR developed a model Critical Area ordinance with the specific zoning code provisions, definitions, and regulations that local units are required to adopt to comply with the MRCCA Rules, and the model ordinance also includ...
