Waiving the 45 day notice requirement and approving the Liquor-Outdoor Service Area (Sidewalk), Wine On Sale, and Malt On Sale (Strong) licenses for Clam Lake Partners, LLC, d/b/a 128 Café (License ID #20130003605), 128 Cleveland Avenue North.

WHEREAS, the licensee requested a waiver of the 45-day notice requirement and approval of the Liquor-Outdoor Service Area (Sidewalk), Wine On Sale and Malt On Sale (Strong) licenses for Clam Lake Partners, LLC d/b/a 128 Café (License ID #20130003605) located at 128 Cleveland Avenue North in Saint Paul; and
WHEREAS, this application represents a change in ownership; and
WHEREAS, on August 13, 2013, the Union Park District Council voted to support the licensee's request to waive the 45 day notice requirement and approve the issuance of the Liquor-Outdoor Service Area (Sidewalk), Wine On Sale and Malt On Sale (Strong) licenses; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the licenses and that the failure to grant the 45 day waiver and the consequent delay in approving the licenses would cause exceptional and unusual hardship to the license applicant; now, therefore, be it,
RESOLVED, the 45 day notice requirement is hereby waived and the Liquor-Outdoor Service Area (Sidewalk), Wine On Sale and Malt On Sale (Strong) licenses are hereby approved for Clam Lake Partners, LLC d/b/a 128 Café located at 128 Cleveland Avenue North in Saint Paul.
