Purpose of Appeal
Just became aware of Correction Notice 9 days ago. Contacted James Thomas to get time to do repairs. Never returned my call. I believe James Thomas has a personal vendetta against me and my family. Apparently the first inspection notice was sent to my mother, not me. James Thomas told my mother and my tenant that the house is in foreclosure. The house is not in foreclosure. He also told my tenant my dad is in prison. My dad has never been to prison. James Thomas is trying to get my tenant to move unnecessarily.

The deficiency list Mr. McCarty filed was untimely. Staff found a more updated deficiency list, which is actually an order to vacate. Numerous calls were made to Mr. McCarty to discuss this with him. Each attempt to call him goes to voice mail and no calls were returned. Legislative Hearing time has been changed to 11:00 a.m. instead of 1:30 p.m. Mr. McCarty has been informed via voice mail of the time change. Staff will also mail this new time change to Mr. McCarty.

WHEREAS, in the matter of the Appeal of Charlie McCarty to a Revocation of Fire Certificate of Occupancy and Order to Vacate at 1734 SEVENTH STREET EAST, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council deny the appeal and grant an extension to June 30, 2012 for the interior work including ORSAT test and smoke detector testing; deny the appeal and grant an extension to July 15, 2012 for all exterior work; Now, Therefore, Be It
