Pertaining to Agency Agreement No. 03012 with the State of Minnesota providing for reimbursement of State costs to remove and dispose of water main on T.H. 5 Bridge No. 9300 between Shepard Road and Fort Snelling.

WHEREAS, the State of Minnesota, acting by and through its Commissioner of Transportation (the "State") intends to let a contract for State Project No. 6201-86 for the reconstruction of Trunk Highway 5 from Hennepin-Ramsey County line to just north of Edgcumbe Road in the city of Saint Paul; and
WHEREAS, the Board of Water Commissioners of the City of Saint Paul (the "Board") owns and operates certain water facilities presently located within the limits of said project; and
WHEREAS, the State has determined that removal of certain abandoned Board facilities is necessitated by the construction of said project, and that Minnesota Statutes provide for this relocation work to be accomplished as part of a state highway construction contract; and
WHEREAS, the State prepared Agreement No. 03012 to provide for the reimbursement of State costs related to said removal, at an estimated cost of $119,070, with final costs to be determined by the actual bid items in the awarded contract; and
WHEREAS, said Agreement has been reviewed and approved by the assistant city attorney; now, therefore, be it
RESOLVED, that Agreement No. 03012 between the Board of Water Commissioners of the City of Saint Paul and the State of Minnesota pertaining to reimbursement of the State's cost related to the removal and disposal of abandoned Board water facilities within State Project No. 6201-86 Trunk Highway 5 is hereby approved, and that the proper officers are hereby authorized and directed to execute said agreement on behalf of the Board.
