Approving adverse action against all licenses held by Kopilenko International Wines & Liquors, d/b/a International Wines & Liquors at 710 Cleveland Avenue South.

WHEREAS, all licenses held by Kopilenko International Wines & Liquors d/b/a International Wines & Liquors (License ID #0015928) for the premises located at 710 Cleveland Avenue South in Saint Paul were the subject of a Notice of Violation dated October 16, 2013; and
WHEREAS, an employee of the licensee failed a liquor compliance check conducted by the Saint Paul Police Department by selling alcohol to an underage person on October 7, 2013 in violation of Minn. Stat. § 340A.503, Subd. 2; and
WHEREAS, per Saint Paul Legislative Code § 409.26(b) (3), the licensing office recommended a $500.00 matrix penalty;
WHEREAS, the licensee sent a letter in response to the Notice of Violation to admit the facts, contest the $500.00 matrix penalty and request a public hearing which was held on November 20, 2013; now, therefore, be it
RESOLVED, Kopilenko International Wines & Liquors d/b/a International Wines & Liquors is hereby ordered to pay a matrix penalty of $500.00 for failing a liquor compliance check conducted by the Saint Paul Police Department and selling alcohol to an underage person on October 7, 2013.
