Approving adverse action against the Auto Repair Garage license held by Superior Auto Repair, Inc., d/b/a Superior Auto Repair at 1324 Arcade Street.

WHEREAS, the Auto Repair Garage license held by Superior Auto Repair, Inc. d/b/a Superior Auto Repair (License ID #20120000708) for the premises located at 1324 Arcade Street in Saint Paul was the subject of a Notice of Violation sent on February 10, 2015, stating that during an inspection on February 5, 2015 a DSI Inspector documented violations to license conditions #1 & #9; and
WHEREAS, this was the second violation to the license conditions within the past twelve (12) months, so per Saint Paul Legislative Code ยง 310.05 (m) (1), the licensing office recommended a $1,000.00 matrix penalty; and
WHEREAS, on February 12, 2015, the licensee called the City Attorney's Office regarding the notice and said he wished to consult with an attorney before deciding which option to select; and
WHEREAS, the licensee failed to follow-up regarding the Notice of Violation to either pay the $1,000.00 matrix penalty or request a hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $1,000.00 matrix penalty or request a hearing by February 20, 2015, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Superior Auto Repair, Inc. d/b/a Superior Auto Repair is ordered to pay a matrix penalty of $1,000.00 for violations to license condition #1 and #9 documented by a DSI Inspector during an inspection on February 5, 2015.
