Authorizing the City of Saint Paul to execute a Lease Agreement with Union Park District Council for the creation of a dog park on city-owned land at Ayd Mill Road and Hamline Avenue.

WHEREAS, the Union Park District Council ("UPDC") has requested the use of a vacant parcel of land at Ayd Mill Road and Hamline Avenue to establish an off-leash dog area; and
WHEREAS, the property was originally acquired for street purposes. In 1962 the Department of Public Works determined that the property was not needed for street purposes and asked that it be transferred to the Department of Parks and Recreation. Although a resolution to this effect was passed by the City Council, actual maintenance and control of the piece of land remained with the Department of Public Works; and
WHEREAS, the City, through the Departments of Public Works and Parks, is willing to lease the vacant parcel to UPDC to improve and maintain the site as a dog park for the benefit of the public, but does not intend this lease to establish the parcel as parkland subject to Saint Paul City Charter Chapter 13; and
WHEREAS, Saint Paul Administrative Code § 86.03 requires that leases longer than one year be approved by the City Council; and
WHEREAS, Saint Paul Legislative Code §170.06 requires that the city council approve the designation of an off-leash dog area by resolution; now, therefore be it
RESOLVED, that the City Council hereby authorizes the proper city officials to execute said Lease Agreement with UPDC in a form and content substantially as set forth in the attached Exhibit A.
