Pertaining to an Addendum No. 1 to Agreement for Water Service with the City of Minneapolis providing for a second connection between the Saint Paul and Minneapolis water systems.
Body
WHEREAS, the Board of Water Commissioners of the City of Saint Paul (“Board”) and the City of Minneapolis (“Minneapolis”) entered into an agreement on September 12, 2017 establishing the rights and obligations of the parties with respect to a connection between their respective water systems that either party can use to supplement its water supply in the event of emergency or other limited conditions; and
WHEREAS, that connection was constructed by the Metropolitan Council inside a buried vault on University Avenue at Emerald Street SE as part of the utility relocation work of its Central Corridor Light Rail Project, the ownership of the vault and its appurtenances was transferred to the Board and the Minneapolis; and
WHEREAS, the parties desire to add a second connection governed by the same terms and conditions as the first connection; and
WHEREAS, a second connection is to be constructed in Como Avenue just east of its intersection with 33rd Ave SE in conjunction with City of Saint Paul Public Works Project No. 20-P-8178, Como Avenue Reconstruction Phase III; and
WHEREAS, staff has drafted an Addendum to Agreement for Water Service establishing the basis of the sharing of the costs to construct the second connection with all other rights and obligations as to maintenance and use the same as the first connection; and
WHEREAS, the assistant city attorney has approved said agreement as to form; now, therefore, be it
RESOLVED, that the Addendum No. 1 to Agreement for Water Service between the Board of Water Commissioners of the City of Saint Paul and the City of Minneapolis governing the construction, use, and maintenance of a connection between the water service systems of the parties is hereby approved, and that the proper officers are hereby authorized and di...
