Amending the commercial development district known as the Schmidt Brewery Commercial Development District to remove liquor license restrictions.

SECTION 1
WHEREAS, in 2013, a Commercial Development District was adopted for the Schmidt Brewery property to support the redevelopment and revitalization of the property that set the number of restaurants and bars that could obtain full liquor licenses within the District. The numbers reflected an increase over what was allowed elsewhere in the City outside of downtown; and
WHEREAS, in 2014, the Saint Paul City Charter was amended to eliminate the number and location restrictions for restaurants to obtain a full liquor license which allowed an endless number of restaurants to receive full liquor licenses throughout the City; and
WHEREAS, all liquor licenses allowed for the Schmidt Brewery District are currently being utilized; and
WHEREAS, Keg and Case (located within the Schmidt Brewery Commercial Development District) is looking to locate more restaurants with full liquor in their building; and
WHEREAS, because the Schmidt Brewery Commercial Development District was created before the Charter Amendment adoption, the District’s ordinance language it states that the Schmidt Brewery Commercial Development District shall be limited to no greater than four (4) total liquor licenses and that three (3) of the four total licenses may only be granted to restaurants, as defined in Section 409.02 of the Saint Paul Legislative Code; and
WHEREAS, the goal of the District language was not to be more restrictive than the rest of the city for the number of restaurants allowed to obtain full liquor licenses; and
WHEREAS, council wishes to lift the cap on the number of restaurant full liquor licenses in the Schmidt Brewery Commercial Development District; and
