Pertaining to a Notice to Terminate the Trout Brook Sewer Interceptor Location Services Agreement with Capital Regions Watershed District.

WHEREAS, the Board entered into a Trout Brook Sewer Interceptor Location Services Agreement with Capital Regions Watershed District on May 13, 2008 to provide Gopher State One Call locating of the District’s Trout Brook Sewer (the “Agreement”); and
WHEREAS, Board forces are not well equipped to locate sewers and the Board desires to terminate the Agreement; and
WHEREAS, the Agreement provides that it may be terminated upon three months’ written notice by either party to the other, and
WHEREAS, staff has prepared a Notice to Terminate the Trout Brook Sewer Interceptor Location Services Agreement to be effective, September 1, 2017, which when executed and delivered to the District by May 31, 2017, will provide the required three-month notice; now, therefore, be it
RESOLVED, that the Notice to Terminate the Trout Brook Sewer Interceptor Location Services Agreement is hereby approved and that the proper officers are hereby authorized and directed to execute said Notice on behalf of the Board, and, be it
FURTHER RESOLVED, that staff is hereby directed to deliver said executed Notice to Capital Regions Watershed District by no later than May 31, 2017.
