WHEREAS, adverse action was taken against the Massage Center - A (Commercial) and Massage Practitioner licenses held by Lucinda A. Pepper d/b/a Embodied Health, LLC (License ID #20070003052) for the premises located at 2500 University Avenue West in Saint Paul, by Notice of Intent to Suspend Licenses dated March 29, 2012, alleging licensee failed to pay delinquent license and late fees of $428.00 and submit the following information: 1) a list of employee names and license numbers; 2) a current certificate of General and Professional Liability insurance with a 30-day notice of cancellation and naming the City of Saint Paul as additional insured and 3) Proof of Affiliation; 4) a completed Certificate of Compliance Minnesota Workers' Compensation Law form; and
WHEREAS, per Saint Paul Legislative Code §310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend Licenses to pay the delinquent license and late fees and submit required information; and
WHEREAS, the Notice of Intent to Suspend Licenses stated that if the licensee failed to pay the delinquent license and late fees and submit required information by April 9, 2012, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Massage Center - A (Commercial) and Massage Practitioner licenses held by Lucinda A. Pepper d/b/a Embodied Health, LLC is hereby suspended for failure to pay delinquent license and late fees of $428.00; and
