Summary

Determining that this appeal is moot and no further action is needed on the matter.

 

Body

WHEREAS, on October 16, 2024, landlord and owner of a property located at 1391 HAZELWOOD STREET, (“Property”), filed a request to increase rents at the Property (“Application”), as allowed under Chapter 193A of the City of Satin Paul Legislative Code: and

 

WHEREAS, landlord’s request was approved by City of Saint Paul (“City”) staff; and

 

WHEREAS, James W. Bush and Linda D. Dear, tenants of the Property, (“Tenants”) submitted an appeal to the City Council of the City of Saint Paul (“Council”) contesting the rent increase; and

 

WHEREAS, the City’s Legislative Hearing Officer held a hearing concerning this appeal on December 12, 2024; and

 

WHEREAS, on January 22, 2025, the Council unanimously voted to deny the Tenants’ appeal; and

 

WHEREAS, Tenants’ appealed the Council’s decision to the Minnesota Court of Appeals (“Court”); and

 

WHEREAS, on December 29th, 2025, the Court released an opinion affirming in part, reversing in part, and remanding the appeal for further deliberation by the Council; and

 

WHEREAS, on August 4, 2026, City staff discovered that the Property was sold to Chibuzor Nnaji (“Owner”); and

 

WHEREAS, on September 2, 2026, City staff communicated with Owner and Owner informed Staff that they do not wish to pursue the Application, confirmed via letter on September 4, 2026; and

 

WHEREAS, because Owner no longer wishes to pursue the Application on which this appeal was based, this matter is now moot, and no further action is required on this matter; Now, Therefore, Be It

 

RESOLVED, that the Saint Paul City Council hereby finds that this matter is now moot and requires no further action.
