Accepting a sanitary sewer easement from 2315 Highland Parkway LLC, Paster Doneda LLC, and Doneda Apartments LLC in conjunction with the redevelopment of property in the Highland Park community by Paster Properties.
Body
WHEREAS, Paster Properties ("Developer") is proposing a development along Highland Parkway and Mississippi River Boulevard (the "Project") within the properties located at 2315 Highland Parkway and 706 Mississippi River Boulevard (the "Development Property"); and
WHEREAS, as part of the site plan approval process for the project, the Department of Public Works ("Public Works") of the City of Saint Paul ("City") is requiring a permanent sanitary sewer easement ("Easement") along the westerly boundary of the Development Property for a relocated sewer line that currently lies within the interior sidewalk easement; and
WHEREAS, the Developer has agreed to provide the Easement and is now requesting that the City accept the Easement, as provided in Exhibit A attached hereto; and
WHEREAS, Public Works and the City Attorney's Office have reviewed and approved the Easement as attached; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul does hereby accept the Easement, as set forth in Exhibit A, and authorizes the proper city officials to accept an executed original of same and record with the Ramsey County Recorder's Office and/or Registrar of Titles.
