Accepting a Dedication of Easement from CH Midway, LLC to facilitate creation of two parking bays for vehicles along the Wirtz Beverage property at 429 and 475 Prior Avenue North.

WHEREAS, on March 21, 2012 the City Council adopted RES PH 12-53, a Final Order approving the installation of a bicycle facility along Prior Avenue from Summit Avenue to Pierce Butler Route by installing various types of signage, re-striping the roadway to include bike lanes, and re-striping existing bike lanes; and
WHEREAS, on October 3, 2012 the City Council ratified an assessment for the construction of two parking bays and a sidewalk along the west side of Prior Avenue between Ferona and Oakley Avenue, which was requested by CH Midway, LLC, owner of 429 and 475 Prior Avenue North, to compensate for the loss of on-street parking as a result of the bicycle project along Prior Avenue; and
WHEREAS, the parking bays and sidewalk are located partially within the property owned by CH Midway, LLC, thus requiring the dedication of a right-of-way easement to enable the public to use the parking bays and sidewalk; and
WHEREAS, CH Midway, LLC desires to grant a right-of-way easement to the City of Saint Paul for the parking bays and sidewalks; now, therefore be it
RESOLVED, that the Council of the City of Saint Paul hereby accepts said Dedication of Easement, and directs and authorizes the proper city officials to record it with the Ramsey County Recorder's Office or Registrar of Titles.
