Authorizing the City to enter into an agreement with the Minnesota Commercial Railway for the Cleveland Railroad Crossing Improvement Project.

WHEREAS, the City has a project to improve the railroad crossings on Cleveland Avenue at Wabash Avenue and Myrtle Avenue;
WHEREAS, Minnesota Commercial Railway owns and operates the rail at these crossings and has agreed to replace the crossing surfaces at these locations; and
WHEREAS, the City has agreed to reimburse the Minnesota Commercial Railway for the replacement of the crossing surfaces at these locations; and
WHEREAS, this Crossing Surface Installation Agreement (Agreement) outlines the terms and conditions for the implementation of this project; now, therefore be it
RESOLVED, that the Mayor and the proper City Officials are hereby authorized and directed for on behalf of the City to enter into this agreement with the Minnesota Commercial Railway, a copy of which is before Council and is made a part hereof; and, be it finally
RESOLVED, that the Mayor and the proper City Officials are authorized to execute the Agreement and any amendments to the Agreement.
