Approving adverse action against all licenses held by Raymond Avenue Cooperative At Hampden d/b/a Hampden Park Co-op located at 928 Raymond Avenue in Saint Paul.
 
Body
WHEREAS, adverse action was taken against all licenses held by Raymond Avenue Cooperative At Hampden d/b/a Hampden Park Co-op (License ID #0047695) for the premises located at 928 Raymond Avenue in Saint Paul by Notice of Violation dated February 22, 2011, alleging the licensee was cited for two Critical-Major Environmental Health Code violations during a re-inspection on November 19, 2010 and December 22, 2010; and
 
WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (9), the licensing office recommended a $175.00 matrix penalty and required correction of the violation; and
 
WHEREAS, on January 26, 2011, the Environmental Health Division of DSI conducted a re-inspection and found the licensee had abated both violations and was now in compliance; and
 
WHEREAS, the licensee was still assessed a $175.00 matrix penalty for the one (1) Critical-Major Environmental Health Code violation from November 19, 2010 that had not been corrected by the December 19, 2010 deadline; and
 
WHEREAS, the licensee did not respond to the Notice of Violation to pay the $175.00 matrix penalty; and
 
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $175.00 matrix penalty by March 4, 2011, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
 
RESOLVED, Raymond Avenue Cooperative At Hampden d/b/a Hampden Park Co-op licensee is ordered to pay a matrix penalty of $175.00 for the one (1) Critical-Major Environmental Health Code violation from November 19, 2010 that had not been corrected by the December 19, 2010 deadline. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
