Authorizing the Department of Parks and Recreation to enter into a two year Waste Delivery Agreement with Ramsey/Washington Recycling & Energy Board which includes an indemnification clause.

 

Body

WHEREAS, the Ramsey/Washington Recycling & Energy Board and Resource Recovery Technologies are in the process of purchasing a waste processing facility in Newport; and

WHEREAS,  the Department of Parks and Recreation currently hauls waste to the Newport facility, and wishes to continue to do so, but the current agreement ends on December 31, 2015; and

WHEREAS, the Ramsey/Washington Recycling & Energy Board has provided the attached contract for execution by the City of Saint Paul as a hauler to provide a two year Waste Delivery Agreement for the Newport facility; and

WHEREAS, the Agreement requires the City to indemnify the Ramsey/Washington Recycling & Energy Board and such indemnification is an expenditure of public money which needs a public purpose; and

WHEREAS,   the Newport waste processing facility is the closest facility to the city and having to haul waste to another facility would increase the costs to the City of waste hauling and halers delivering waste from Ramsey or Washington Counties will be provided a rebate of $12 per ton; and

WHEREAS, the City Council finds that there is a public purpose in entering into the attached agreement, by reducing the costs of waste hauling; now, therefore, be it

RESOLVED, that the City Council authorizes the appropriate city officials to enter into the attached Waste Delivery Agreement, which contains a promise of indemnification.
