Approving adverse action against the Cigarette/Tobacco license held by AM PM Gas d/b/a Marathon Market located at 719 Payne Avenue in Saint Paul.

WHEREAS, adverse action was taken against the Cigarette/Tobacco license held by AM PM Gas d/b/a Marathon Market (License ID #20070001341) for the premises located at 719 Payne Avenue in Saint Paul by Notice of Violation dated November 5, 2010, alleging that on October 21, 2010, a clerk from the establishment sold tobacco products to an underage person in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 324.07 (c); and
WHEREAS, this is the first violation for the sale of tobacco to an underage person, so per Saint Paul Legislative Code § 324.11 (b) (1), the licensing office recommended a $200.00 matrix penalty; and
WHEREAS, licensee did respond to the Notice of Violation on November 18, 2010, indicating the payment would be mailed that day, but a check of DSI records shows the payment was never received; now, therefore, be it
RESOLVED, that AM PM Gas d/b/a Marathon Market is hereby ordered to pay a $200.00 matrix penalty for selling tobacco products to a minor on October 21, 2010. Payment of such penalty shall be made within thirty days of the date of the adoption of this resolution.
