Purpose of Appeal: This building is being occupied by family. Lana has a hearing scheduled for March 5 on her work comp issues. We would appreciate having the appeal hearing scheduled after Mar 5 if possible.

WHEREAS, in the matter of the Appeal of Roger and Lana Cheatham to a Vacant Building Registration Notice at 1769 Saint Anthony Avenue, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council waive the vacant building fee through July 1, 2024; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant the following extensions for the March 11, 2024 Fire Inspection Orders:
1) grant to April 23, 2024 for items 6, 9 (stabilizing stucco), 25 and 28 (under general building permit);
3) grant to March 30, 2024 for Items 2 - 4, 10 - 12, 14 - 16, 21 -24, 29 and 30 which are reported to be completed and shall be reinspected on April 3, 2024 at 10:30 am;
4) grant to July 1, 2024 for balance of the orders (5, 7, 8, 13, 17 - 20, 26 & 27); and
WHEREAS, the Legislative Hearing Officer recommends that Unit 3 may not be occupied past April 23, 2024 unless it is certified by the Department of Safety and Inspection and no other units may be occupied until Fire Certificate of Occupancy for the building is issued;
WHEREAS, the Legislative Hearing Officer recommends that this property be released from the Registered Vacant Building Program pending completion of the work outlined in the March 11, 2024 orders, noting failure to meet the deadlines will result in being ...
