Accepting a Right of Entry permit between the City of Saint Paul ("City") and the Arlington Hills Lutheran Church ("AHLC") to construct an alleyway on Church property at 1115 Greenbrier Street.
Body
WHEREAS, the construction of a 20 foot wide east west alleyway between Payne Avenue and Greenbrier Street in association with the Payne Maryland Recreation Center and Library project conforms to City Standards and allows safe transportation for local residents and City services ; and
 
WHEREAS, the Right of Entry permit ("Permit") allows the ("City") to access ("AHLC") property in advance of securing dedicated easement rights for future alley right of way that will connect Payne Avenue and Greenbrier Street as depicted in Exhibit A attached hereto; and
WHEREAS, the City and ("AHLC") have mutually prepared the ("Permit") for the City's use of property, attached hereto as Exhibit B; and
WHEREAS, said ("Permit") requires indemnification by the City and its contractors for any claims, damages, liabilities and costs related to the City's use of the ("AHLC") property; now, therefore be it
RESOLVED, that the Mayor and City Council do hereby approve said ("Permit") in a form and content substantially as set forth in Exhibit A, and authorize and direct the proper city officials to execute said ("Permit");
