Rescinding the Final Order for acquisition of 1200 Jackson Street. (Laid over from June 8 and June 15)

WHEREAS, on June 2, 2010 the City Council approved a Final Order (RES 10-594) to authorize the total acquisition of the property located at 1200 and 1202 Jackson Street, Saint Paul (the "Jackson Property"), for the public purpose of establishing a trail head, parking area and gateway to the Trout Brook Regional Trail and Trillium Nature Sanctuary, as shown on the attached Exhibit A; and
WHEREAS, the City obtained an independent real estate appraisal of the Jackson Property and submitted a written purchase offer to the owners of said Jackson Property (the "Owners"); and
WHEREAS, said Owners secured their own appraisal services to determine the value of the Jackson Property and/or a suitable replacement property, but did not present the City with a written counter offer or appraisal report that would have provided a basis for serious negotiations on the purchase; and
WHEREAS, the Owners and City subsequently have been unable to negotiate a direct sale and purchase of the Jackson Property; and
WHEREAS, the City has not wished to acquire the property by use of eminent domain; and
WHEREAS, on February 1, 2011 the City notified the Owners that the City had withdrawn its offer to purchase the Jackson Property and would no longer pursue the acquisition; now, therefore be it
RESOLVED, that the Mayor and City Council hereby rescind said Final Order, and direct the proper city officials to cease all actions to acquire the Jackson Property, including acquisition via eminent domain.
